Terms & Conditions

The laws of the Republic of Latvia provide that the owner of an online store must stipulate the conditions for the delivery and return of products, as well as the right of refusal. Such provision is called a distance contract (Cabinet Regulation).

Distance contract

The seller of the products offered on this website, party of the first part, hereinafter referred to as the Seller, and the party that submits the order, hereinafter referred to as the Buyer, party of the second part, hereby conclude the following Contract:

The Seller undertakes to sell and deliver the products specified in the Buyer’s order to the Buyer. The Seller undertakes to sell the product Balance Board, which has been made of plywood, covered with a frosted colour, the design sample of which has been registered with the Patent Board of the Republic of Latvia under number D 15 724, hereinafter referred to as – the Product, but the Buyer undertakes to purchase and pay for the Product in accordance with the provisions of the Contract. The unique code of the Product to be transferred to the Seller, which has been indicated on the product. The Seller sells the Buyer the Product as a set together with two metal balls and two plastic worksheets.

Ownership and possession right

Ownership right and possession right for the Product shall transfer to the Buyer at the moment when the respective funds are transferred to the account of the Buyer as the settlement of the invoice for the goods.

Rights and obligations of the Buyer

The buyer has the duty to use the Product in accordance with the instructions provided in the user manual of the Product. By signing this Contract, the Buyer confirms that they have read the user manual of the Product and that they understand the content thereof.

The Buyer shall have the duty to use reasonable methods in order to prevent the Product from coming into the use of third parties without having completely explained the user manual to the respective person.

The Seller shall not be held liable for any damage to the Product that has arisen during the use of the Product in violation and/or ignoring the user manual of the product.

The Buyer shall be liable for the losses inflicted on the Seller, including direct and indirect, including lost profit and other losses and damages associated with illegal use or application of the Product, especially as regards the violations of design sample No. D 15 724 registered for the Seller.

Order of delivery and payment

The Buyer orders the products via this website, indicating the type and quantity of the products ordered. The Buyer is entitled to pay for the products using the payment tools integrated in the online shop, or by paying the invoice issued by the Seller and sent to the Buyer. The bill is prepared electronically and is valid without a signature.

The Seller shall ensure the delivery of the Product within 20 days from the date when payment for the Products has been received, by harmonising the delivery time with the Buyer.

Right of Withdrawal

The Buyer has the right to withdraw from the Product purchase within 14 calendar days of receiving the Product by sending a letter of withdrawal to the Seller. The Seller e-mails the withdrawal letter form to the Buyer, as requested by the Buyer.

The Buyer must return the item to the Seller within 7 days of sending the letter of withdrawal. All costs of returning the item to the Seller must be paid by the Buyer.

The Buyer may not exercise the right of withdrawal if:

by their nature, the ordered products are non-returnable, wear quickly or are perishable;
the ordered products are custom-made for the Buyer according to an individual order;
the buyer has opened the packaging of the audio or video record, or software.

Section 12, Part 6 of the Consumer Rights Protection Law of the Republic of Latvia states that “the consumer shall be responsible for maintaining the quality and safety of the product during the term of exercising the right of withdrawal.” The Seller reserves the right to deny the Buyer the right of withdrawal or to charge compensation in the event of damage to the Product, neglect in using the Product, failure to follow the instructions or loss of original packaging or significant damage to the Product packaging.

Processing of data By entering the requested data and preparing the order, the Buyer confirms that the Buyer is aware of and accepts the fact that the data they provide will be used to enable the Seller to receive the Buyer’s order, and to deliver the products as required by the laws of the Republic of Latvia. Entering the data, the Buyer accepts that e-mail messages associated with the processing of the Buyer’s order will be sent to the Buyer.
